Privacy Policy

Covering www.magnifyed.us, magnified.ai, and the MagnifyED platform

1.  Who We Are and What This Policy Covers

Magnify by Design, Inc., a Delaware corporation doing business as MagnifyED ("MagnifyED," "we," "us," or "our"), respects your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices you have, when you visit our website at www.magnifyed.us (the "Site"), use the MagnifyED platform (the "Platform"), or otherwise interact with us (collectively, the "Services").

1.1  Scope.  This Privacy Policy covers personal information we collect as a "controller" or "business" in connection with the Services. It does not cover personal information that we process on behalf of a school, district, or other educational institution under a separate written agreement; that processing is governed by our agreement with the institution, and questions about it should be directed to the institution.

 

2.  Information We Collect

2.1  Information You Provide.  We collect information you give us when you (a) subscribe to our newsletter (first name, last name, and e‑mail address); (b) contact us through the Site (your name, e‑mail, and message contents); (c) create an account on the Platform (name, e‑mail, password, role, grade level, and employer or district affiliation); (d) purchase a subscription (billing contact and payment information, which is processed by our payment processor and not stored on our systems); and (e) use the Platform (Inputs you upload, prompts you submit, settings, and Generated Materials).

2.2  Information Collected Automatically.  When you visit the Site or use the Platform, we and our service providers may collect device and usage information, including IP address, browser type, operating system, referring URLs, pages viewed, dates and times of access, and similar technical data, through cookies, pixels, and similar technologies.

2.3  Information from Third Parties.  We may receive information about you from third parties, including our payment processor (transaction confirmation), single sign‑on providers (if you choose to sign in through them), and analytics providers.

 

3.  How We Use Information

We use the information described above to:

  • provide, operate, secure, and improve the Services, including authenticating users and personalizing the user experience;

  • process your Inputs through automated AI tools to generate Generated Materials at your direction;

  • process payments and manage subscriptions;

  • communicate with you about your account, transactions, updates to the Services, and (with your consent or where otherwise permitted by law) marketing and educational content;

  • comply with applicable laws and respond to lawful requests, subpoenas, and other legal process;

  • detect, investigate, and prevent fraud, abuse, security incidents, and other harm; and

  • conduct analytics about how the Services are used, in aggregated or de‑identified form where reasonably practicable.

 

4.  How We Use Your Inputs and AI Training

4.1  No Training on Your Inputs.  We do not use your Inputs or your Generated Materials to train, fine‑tune, evaluate, or improve any AI model used to serve any other customer. We do not retain your Inputs in a database for other users’ benefit, and we do not manually modify your Inputs ourselves.As described in our Terms of Service, the Service maintains a centralized library of stand‑alone vocabulary images generated in response to word‑level definition requests; this image library may be reused across Users to support response time, cost, and consistency. We do not retain or reuse any other Inputs or Generated Materials in this way.

4.2  Third‑Party Model Providers.  We use third‑party AI model providers to process your Inputs and produce Generated Materials. We require these providers to handle your content under confidentiality and data‑protection obligations consistent with this Policy and our agreements with them. Where providers offer no‑training enterprise modes for their APIs, we use those modes.

4.3  Operational Telemetry.  We use de‑identified or aggregated usage data (such as feature‑use counts, error rates, and latency metrics) to operate, secure, and improve the Services. This data is not used to identify any individual and is not used to train models served to others.

 

5.  Cookies and Similar Technologies

5.1  What We Use.  We and our service providers use cookies, web beacons, and similar technologies to operate the Site, remember preferences, analyze traffic, and measure marketing performance. Our Site is hosted on Wix; Wix’s own cookies and tools (including basic analytics) operate on the Site by default.

5.2  Your Choices.  Most browsers let you refuse or delete cookies. Doing so may affect the functionality of the Services. Where required by law, we will obtain your consent before placing non‑essential cookies.

5.3  Session Replay and Chatbots.  We do not currently use session‑replay tools (such as FullStory, Hotjar, Microsoft Clarity, or Datadog Session Replay) or third‑party chatbots that capture free‑text user input on the Site or the Platform. If we deploy any such technology in the future, we will update this Policy and obtain consent where required by applicable law (including California Penal Code § 632).

 

6.  How We Share Information

We share personal information in the following limited circumstances:

  • Service providers and sub‑processors who help us operate the Services, including our hosting and infrastructure provider, our payment processor, our e‑mail and communications platform, our AI model providers, and our analytics providers. A current list is available on request and is published at www.magnifyed.ai/subprocessors.

  • Schools and districts you are affiliated with, when you use the Services in connection with an institutional account.

  • Legal, safety, and compliance: when we believe disclosure is necessary to comply with applicable law, lawful requests, or legal process; to enforce our Terms; to prevent fraud or abuse; or to protect the safety, rights, or property of MagnifyED, our users, or the public.

  • Business transfers: in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of our assets, subject to appropriate confidentiality and notice obligations.

  • With your direction or consent: when you ask us to share information with a specific third party.

6.1  We Do Not Sell Personal Information.  We do not sell personal information, and we do not "share" personal information for cross‑context behavioral advertising, as those terms are defined under the California Consumer Privacy Act and similar laws.

 

7.  Children and Students

7.1  Not Directed to Children.  The Services are intended for use by adult educators, curriculum developers, and school or district personnel. We do not direct the Services to, and we do not knowingly collect personal information from, children under thirteen (13). If you believe a child under thirteen has provided personal information to us, please contact us at privacy@magnifyed.us and we will delete it.

7.2  No Processing of Student Data.  The Services are not designed to receive, process, store, or use student data of any kind, whether or not it constitutes personally identifiable information. Our Terms of Service prohibit users from uploading any information that identifies or could reasonably identify a student, including information that would be regulated by the Family Educational Rights and Privacy Act (FERPA), the Children’s Online Privacy Protection Act (COPPA), or any state student‑privacy law. If you believe student information has nevertheless been provided to us through the Services, please contact us at privacy@magnifyed.us and we will delete it.

 

8.  Data Retention

8.1  How Long We Keep Information.  We retain personal information for as long as needed to provide the Services to you, comply with our legal obligations, resolve disputes, and enforce our agreements. We retain Inputs and Generated Materials for the duration of your account and for a reasonable wind‑down period (typically thirty (30) days) after you delete the relevant content or close your account, unless a longer retention period is required by law. De‑identified or aggregated data may be retained for longer.

 

9.  Security

9.1  Our Practices.  We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against accidental or unlawful loss, access, use, alteration, or disclosure, including encryption in transit, access controls, and vendor due diligence. No system is perfectly secure, however, and we cannot guarantee the security of information transmitted to or stored on the Services.

9.2  Notice of Security Incidents.  If we determine that a security incident has compromised your personal information, we will notify you and applicable regulators consistent with applicable law.

 

10.  Your Choices and Rights

10.1  Account Information.  You can review and update most account information through the Platform settings or by e‑mailing us at privacy@magnifyed.us.

10.2  Marketing.  You may opt out of marketing e‑mails by clicking the "unsubscribe" link in any marketing e‑mail or by contacting us. We will continue to send transactional and service‑related messages.

10.3  Cookies.  See Section 5 above.

10.4  Deletion.  You may request that we delete personal information you have provided to us by e‑mailing privacy@magnifyed.us. We may retain certain information as required by law or for legitimate business purposes (such as fraud prevention).

 

11.  Notice to California Residents

11.1  CalOPPA and CCPA.  This section is provided to California residents under the California Online Privacy Protection Act (CalOPPA) and supplements the rest of this Policy. We do not currently meet the threshold criteria for "business" status under the California Consumer Privacy Act / California Privacy Rights Act, but we voluntarily honor the following commitments:

  • Categories of personal information collected, sources, purposes, and recipients are described in Sections 2, 3, and 6 above.

  • We do not sell personal information and we do not "share" personal information for cross‑context behavioral advertising.

  • We do not knowingly collect or sell the personal information of consumers under sixteen (16).

  • You may request access to, correction of, or deletion of personal information by e‑mailing privacy@magnifyed.us. We will respond consistent with applicable law.

  • We honor Global Privacy Control (GPC) signals received from California browsers as opt‑out requests, as further described in our cookie practices.

  • California Civil Code § 1798.83 ("Shine the Light") permits California residents who have an established business relationship with us to request information about our disclosures of personal information to third parties for direct‑marketing purposes. We do not currently share personal information with third parties for their own direct‑marketing purposes.

 

12.  Other U.S. States and International Users

12.1  Other States.  Residents of other U.S. states may have rights similar to those described in Section 11 under state privacy laws (including Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Iowa, and Delaware). We extend the rights described in Section 10 to residents of those states as a matter of policy and respond to verifiable requests consistent with applicable law.

12.2  International Users.  The Services are intended for users located in the United States. We do not currently offer the Services to users in the European Economic Area, the United Kingdom, or other jurisdictions outside the United States. If you are located outside the United States and choose to use the Services, you do so on your own initiative and at your own risk, and your information will be transferred to and processed in the United States.

 

13.  Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by e‑mail or through the Services at least thirty (30) days before the changes take effect. The "Effective Date" at the top reflects the most recent version. We will review this Policy at least once every twelve (12) months.
